Australian ugg boot maker loses US trademark case

A shoe manufacturer in Australia has been ordered to pay US group Deckers damages of US$450,000 after a Chicago court ruled he had wilfully infringed on a registered trademark by selling ugg boots online to US customers.

The owner of Sydney-based Australian Leather, Eddie Oygur, had argued that “ugg” is a generic term that originated in the 1960s within the Australian surfing community. 

Deckers acquired the UGG Australia trademark in 1995. In its complaint to the US district court, it wrote: “Deckers’ products have been widely accepted by the public and are enormously popular, as demonstrated by over $1 billion in annual UGG sales.”

The jury ordered Mr Oygur to pay the previously mentioned statutory damages after a four-day trial. He may also face an order to pay more in legal costs.
