Old Dominion cleared of Crocs infringement

The International Trade Commission (ITC) has removed Old Dominion Footwear from infringement proceedings instituted by Crocs against twelve competitors.

Crocs, Inc. filed the complaint in 2006 alleging infringement of its design and utility patents for foam footwear by twelve respondents. It sought a general exclusion order to prohibit all foam footwear, including Virginia-based Old Dominion Footwear's Quacks shoes, from being imported and sold in the United States. Old Dominion Footwear was not named in the complaint, but its Quacks shoes were alleged to be infringing Crocs' design patent.

The ITC’s decision means that Old Dominion is free to continue selling its AquaDuck line of Quacks shoes.
