Chinese companies plan to appeal EU anti-dumping policy

The Chinese footwear industry is extremely unhappy with the policy, which will remain in effect for two years, and many of the companies affected by the duties now plan to appeal the decision.
An official from Bureau of Fair Trade at MOFCOM stated that some of the companies plan to appeal to the EU Court of First Instance as the industry feels that there are many issues involved in the policy which infringe the legal rights of the Chinese companies. These include the tariff rate treatment, enterprise market economic treatment, the calculation of the anti-dumping duty rate, the time limit in disclosing information and the lack of supervision over the treatment of the companies involved.
According to EU's anti-dumping law, the Chinese companies involved have two months from the implementation of the policy to appeal in the EU court.
The EU imposed the higher 16.5% anti-dumping duty, effective October 7, on all but one of the Chinese producers under scrutiny. The one company exempt from the 16.5% duty will pay an anti-dumping tariff of 9.7%.
