Old Friend files motion against Crocs
During the World Shoe Association trade show in Las Vegas, Australia Unlimited, Inc., owner of Old Friend Footwear, announced its formal response to Crocs' patent infringement suit and announced that it has filed a motion with the US International Trade Commission (ITC) for a partial summary determination in its favour.
The company filed a motion with the ITC seeking removal of NothinZ from Crocs' patent infringement claims brought pursuant to US Patent No. 6,993,858.
Crocs' patent infringement suit was filed against Australia Unlimited and ten other importers of lightweight foam clogs. Australia Unlimited contends that the continued maintenance of infringement claims based on the patent has caused the company unnecessary expense and damage to its reputation.
The company's formal response to the litigation includes a countersuit, seeking a court order invalidating Crocs' patents and holding them unenforceable due to failure to disclose material information to the US Patent and Trademark office.
Old Friend Footwear manufactures Old Friend Sheepskin Slippers and footwear, Old Friend Reflex Massage Sandals, and NothinZ lightweight polymer clogs.
