Court finds for adidas in dispute over stripes
The Court of Justice of the European Union has
dismissed an appeal from Belgian footwear company Shoe Branding Europe
claiming that it should be allowed to bring to market athletic shoes
with two stripes.
Adidas opposed the Belgian company's branding in a long-running dispute,
eventually won the support of the Court of Justice in Luxembourg on
February 24.
Shoe Branding Europe had argued that its use of two
stripes instead of three and of stripes that were different in length
made its footwear look different from that of adidas, but the
authorities announced the similarity was still not enough to avoid
confusion among consumers.
